While it my not mean you get a criminal record, the cop may decide it's easiest to take you downtown and let someone else figure out who's right and who's wrong. I have read about incidences in the UK and Canada. I have not read of any here in the US involving children, but I have read of ones here where people get in trouble for taking photos of the outsides of buildings. I'm not sure if there's a Canadian analogue to this guide. It appears this couple is in a public place, so any expectation that they cannot be photographed would be unreasonable South of the border.
